All persons who elect to participate in the use of a golf cart will be liable and responsible for the payment of the Fee. The fee to use a golf cart is $25.00 per 18-holes per person, or $13.00 per 9-holes per person, and is subject to increase from time to time in the sole discretion of the Club (“Fee”).
Only Members and their respective guests are eligible to obtain the use a golf cart. Anyone wishing to drive a golf cart must possess a valid Driver’s License.
User’s right under the Cart usage is limited to sharing a golf cart with another person (whether or not such person is a participant in the Cart Club Program) as assigned by the Golf Shop unless circumstances, in the sole discretion of the Golf Shop, dictate otherwise, without the requirement of paying a separate rental fee for the use of such golf cart. User’s right cannot be used by any other person. User hereby represents that User is familiar with the operation and use of motor-driven golf carts and has read the instructions appearing on the golf cart and/or made available in the Golf Shop and that User can and will operate and control the same in accordance therewith. User agrees to pay any damages that are sustained to any golf cart in User’s possession. User agrees to not remove the golf cart from the premises of The Saticoy Club and to return the same immediately following each period of use. The Saticoy Club has the right to remove and withhold cart usage based on misuse and improper cart etiquette of both cart and course alike.
Please support your Director of Agronomy, and staff, in keeping our course in top playing condition. We ask that you use good judgement and etiquette when driving a golf cart. Please avoid slopes and wet areas as well as avoiding encroaching on tee boxes and greens.
Golf carts should use cart paths or the rough whenever possible. The cart path exists to save the grass and provide drainage. When going to a ball in the fairway, carts should use entry and exit gates at all times. All par 3’s are always cart path only. When ball is on or around green, carts must be parked on pathway next to putting green.
RELEASE: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOR GOOD AND VALUABLE CONSIDERATION, THE RECEIPT OF WHICH IS HEREBY ACKNOWLEDGED, THE UNDERSIGNED ASSUMES ALL RISKS ON BEHALF OF THE UNDERSIGNED AND THE UNDERSIGNED’S IMMEDIATE FAMILY AND GUESTS AND FURTHER WAIVES AND RELEASES, ON BEHALF OF THE UNDERSIGNED AND THE UNDERSIGNED’S IMMEDIATE FAMILY AND GUESTS, ANY CLAIMS, DEMANDS AND/OR CAUSES OF ACTION WHICH ANY OF THEM MAY HAVE AGAINST THE CLUB AND THE CLUB OWNERS (INCLUDING CLUB OWNER’S PARENT, SUBSIDIARIES AND AFFILIATES) AND/OR ANY MANAGEMENT FIRM RETAINED TO MANAGE AND OPERATE THE CLUB FACILITIES ON A DAY-TO-DAY BASIS, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, PARTNERS, MANAGERS, MEMBERS, EMPLOYEES, REPRESENTATIVES, AGENTS, ATORNEYS, HEIRS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE RELEASEES”), ARISING OUT OF PERSONAL INJURIES, PROPERTY DAMAGE AND THEFT WHICH THE UNDERSIGNED OR THE UNDERSIGNED’S IMMEDIATE FAMILY AND/OR GUESTS MAY SUSTAIN AS A RESULT OF PARTICIPATING IN THE USE (WHETHER AS A DRIVER OR A PASSENGER) OF A GOLF CART AT THE SATICOY CLUB.
THE UNDERSIGNED, ON BEHALF OF THE UNDERSIGNED’S IMMEDIATE FAMILY AND GUESTS, EXPRESSLY WAIVES THE BENEFITS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE, WHICH PROVIDES AS FOLLOWS:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
THE UNDERSIGNED ACKNOWLEDGES AND AGREES THAT THE UNDERSIGNED HAS BEEN REPRESENTED BY LEGAL COUNSEL OF THE UNDERSIGNED’S CHOICE IN CONNECTION WITH THIS APPLICATION AND AGREEMENT AND THAT SUCH LEGAL COUNSEL HAS EXPLAINED TO THE UNDERSIGNED THE PROVISIONS OF THIS SECTION.
